      Last September I had a heart attack and was off work for two months. I did a phased return and everything was ok for a bit, but then things got too much (expecting me to do more than I was able and the like) so I asked to be put in touch with Occupational Health. They made a list of recommendations and for a while these were followed. Now it’s started again. When I complained and pointed out that I was under Occupational Health I was told “they’re only recommendations”. I get the impression that I could drop dead on the shop floor and I would be swept to one side and everything would just carry on. I have heard that I can apply for disability status as I now have a long term health condition (coronary heart disease) which would cover me under the equalities act. Is this true? Any help or advice would be very much appreciated.

        How long ago where you sent thru OH as it may be the case that if the report was produced more than 6 months ago it could be seen as out of date?

        Whilst it is also true OH reports are only recommendations and can be ignored if the manager chooses to – if you are ever dismissed for unacceptable attendance due to ill health any employment tribunal will look dimly on this. A company the size of Tesco should be able to adopt any reasonable adjustment as long as you likewise comply with anything asked of you (ie changing dept/hrs/shifts).

        Personally I would ask your manager to re-refer you to OH and clarify where you currently are with your health, what you can and cant do and what Tesco should do to support you.

        You should also use colleague help or Usdaw to help advise you on the in work with a long term health condition process.

          The OH report was only created a three weeks ago. Recommendations were followed for a week then seemingly forgotten the week after. I get breathless easily and really start to tire at the end of the night shift and whilst I’m getting better, it’s still an issue. I’ll give it another couple of weeks, then speak to OH again if things don’t improve.
          The one thing I will say, they don’t seem to appreciate the stress and fear I feel about it happening again. At all.
